ORDER Date : 18.11.2024 Heard Mr. B. D. Das, learned Senior Counsel assisted by Mr. D. Thaosen, learned counsel for the petitioner. Also heard Mr. C. By way of this application, the petitioner is seeking impleadment of Shri. K. S. Gopinath Narayan, IA & AS, Accountant General (A&E), Assam, Maidamgaon, Beltola, Guwahati-781029 as respondent no. 9 in the accompanying Contempt Petition, i.e. Cont.Cas(C)/716/2023. It appears that the contempt petitioner has filed the accompanying contempt petition for initiation of contempt proceeding Page No.# 4/5 against the contemnor/respondent for alleged willful and deliberate violation of the order dated 19.07.2023 passed by this Hon'ble Court in WP(C) No.1231/2022. It appears that during the pendency of the instant contempt petition, the learned counsel appearing on behalf of the contemnor/respondent has submitted that as the subject relates to pension, the matter has been placed before office of the Accountant General (A&E), Assam for releasing the subject pension and considering that the Accountant General (A&E) since not a party in the instant proceeding, the learned counsel appearing on behalf of the petitioner has sought 2 (two) weeks time to obtain instruction and for doing the needful in the matter. It further appears that that this Court by order dated

18.09.2024 allowed the aforesaid prayer of the learned counsel for the petitioner. In view of the above, it appears that the Accountant General (A&E), Assam is a necessary party for effective adjudication of the accompanying contempt petition. Accordingly, the impleadment application is allowed. As such, it is directed that Shri. K. S. Gopinath Narayan, IA & AS, Accountant General (A&E), Assam is impleaded as a party respondent no. 9 in Cont.Cas(C)/716/2023.
