ORDER 20-11-2024 Heard Mr. F. A. Laskar, learned counsel for the petitioner and Mr. B. Sarma, learned Additional Public Prosecutor, Assam for the State.
¶2Apprehending his arrest, the petitioner, namely, Olee Ahmed Barbhuiya @ Oli Ahmed Barbhuiya, son of Mazahaid Ali Barbhuiya has filed this application under Section 438 CrPC seeking pre-arrest bail in Ratabari P.S. Page No.# 2/2 Case No. 126/2024 corresponding to G.R. No. 1168/2024 registered under Sections 120(B)/406/420 IPC read with Section 66 of the I.T. Act.
¶3Earlier, the Court by order dated 25.06.2024, while calling for the case diary of said Ratabari P.S. Case No. 126/2024, granted interim bail to the petitioner, named above, in said Ratabari P.S. Case No. 126/2024, which was extended till date.
¶4During the deliberation of the matter, Mr. B. Sarma, learned Additional Public Prosecutor, Assam on instruction, submitted that police after completion of investigation of the case has already submitted the charge-sheet in said Ratabari P.S. Case No. 126/2024 vide Charge-Sheet No. 161/2024 dated
14.11.2024.
¶5In view of the above, the petitioner is directed to approach the appropriate forum/authority for his regular bail in said Ratabari P.S. Case No. 126/2024 on or before 29.11.2024.
¶6Till then (i.e., 29.11.2024), the petitioner shall remain on interim bail granted to him earlier on 25.06.2024 in said Ratabari P.S. Case No. 126/2024 corresponding to G.R. No. 1168/2024.
¶7With the above observation and direction, this pre-arrest bail application stands disposed of.
