ORDER 02-12-2024 Heard Mr. J Borah, learned counsel for the petitioners and Mr. B Sarma, learned Additional Public Prosecutor, Assam for the State.
¶2By this application under Section 438 CrPC, the petitioners, namely, (i) Sri Hitesh Deka Page No.# 2/2 @ Hiteswar Deka and (ii) Mrs. Anamika Thakuria, are seeking pre-arrest bail in Geetanagar Police Station Case No. 115/2024 registered under Sections 418/420/406/120-B, corresponding to G.R. No. 2813/2024.
¶3The petitioner No. 2, namely, Mrs. Anamika Thakuria was granted interim bail on
25.06.2024 and subsequently, the petitioner No. 1, namely, Sri Hitesh Deka @ Hiteswar Deka was granted interim bail on 17.07.2024 in said Geetanagar P.S. Case No. 115/2024 and since then both of them are on interim bail.
¶4During the deliberation of the matter, Mr. B Sarma, learned APP, Assam, on instruction, has submitted that police after completion of the investigation of the case has already submitted Charge-Sheet in said Geetanagar Police Station Case No. 115/2024 vide Charge Sheet No. 114/2024 dated 29.10.2024.
¶5In view of the above, the petitioners are directed to appear before the appropriate forum/authority for their regular bail in said Geetanagar Police Station Case No. 115/2024 on or before 07.12.2024.
¶6Till then, i.e., 07.12.2024, the petitioners shall remain on interim bail granted to them earlier on 25.06.2024 and 17.07.2024 respectively.
¶7Accordingly, this pre-arrest bail application stands disposed of.
