Nazrul Islam Laskar v. B Kalyan Chakraborty and Anr

ORDER Date : 10.12.2024 Heard Mr. M. Dutta, learned counsel for the petitioner. Mr. S.M.T. Chistie, learned counsel for the respondent No. 3, has furnished an Order, dated 10.12.2024, issued by the Secretary to the Government of Assam, Department of School Education, wherein it is indicated that the Director of Elementary Education, Assam has been directed to initiate a fresh inquiry following all the provisions of Assam Service (Discipline and Appeal) Rules, 1964 and to complete the process within a period of one month. The order further indicates that the Order dated 29.09.2012 passed by the Director of Elementary Education, Assam imposing a penalty of withholding of five annual increments is stayed till completion of the fresh enquiry. On the perusal of the Order dated 10.12.2024, this Court is of the considered opinion that the respondent has substantially complied with the directions passed by this Court and accordingly, the contempt petition is closed. The Order dated 10.12.2024 is placed on record.
