Ajit Kalita and Anr v. The State of Assam and Anr

ORDER 12-12-2024 Heard Mr. B. M. Deka, learned counsel for the petitioners and Mr. K. K. Parasar, learned Additional Public Prosecutor, Assam for the State.

¶2By this application filed under Section 483 BNSS, 2023, the petitioners, namely,

(1) Ajit Kalita, son of Haladhar Kalita, resident of Village-No.2 Suwagpur, P.S.- Goreswar, District-Tamulpur and (2) Suraj Pradhan, son of Krishna Pradhan, resident of Village-Oubari, P.S.-Goreswar, District-Tamulpur are seeking bail in Goreswar P.S. Case No. 79/2024 corresponding to G.R. No. 895/2024 registered under Sections 137(2)/3(5) BNS read with Section 4 of the POCSO Act, 2012.

¶3During the deliberation of the matter, Mr. K. K. Parasar, learned Additional Public Prosecutor, Assam on instruction, submitted that police after completion of investigation of the case has already submitted the charge-sheet in said Goreswar P.S. Case No. 79/2024 vide Charge-Sheet No. 63/2024 dated 31.10.2024.

¶4In view of the above, the petitioner is directed to approach the appropriate forum/authority for his regular bail in said Goreswar P.S. Case No. 79/2024.

¶5Accordingly, this bail application stands closed.
