(ii) Efforts made on 21.01.2024 a) That the investigating agency/SIT, thereafter made to join Vinay Bains son of Davinder Singh resident of Village Dhariwal, Khilchian, ndPolice Station Purana Shala, District Gurdaspur who is the 2  cousin of Aman @ Jaanu (son of Uncle/Mama of Geeta). That thereafter, the questioning as well as the recording of statement of Vinay Bains was done in presence of the CWC Team. The statement of Vinay Bains in itself brought new facts on the police file as per which, on the date of occurrence i.e. 05.11.2022, he came present alongwith Aman @ Jaanu on the spot of occurrence and missing girl Alisha also came present there. That thereafter, Aman @ Jaanu and Alisha started talking to each other and ultimately a fight started between them as Alisha alleged that there was an obscene video of her. Vinay Bains further stated that the fight between Aman @ Jaanu and Alisha aggravated and ultimately Aman @ Jaanu gave a push/blow to Alisha with both his hands on her chest, due to which she fell back in the canal as they were standing on the edge of the bridge. Thereafter, Aman @ Jaanu and Vinay Bains tried to search for Alisha in the said area and they could not find her. The exact word to word statement of Vinay Bains will further make it clear that what exactly happened at the time of occurrence (however, further cross verification of these facts is still going on by the SIT and no conclusion has been arrived till now). Thus, to avoid repetition the copy of the statement of Vinay Bains dated 21.01.2024 is attached herewith as Annexure R-10/T.

(iii) Efforts made on 22.01.2024 a) That the photographs, screenshots of instagram were taken on police file on 19.01.2024 and were sent through e-mail to the office of Instagram i.e. Meta Platforms, Inc., 1 Meta Way, Menlo Park, CA 94025 by Incharge Cyber Crime Cell, O/o Senior Supdt. of Police, Pathankot, vide letter No. 90- 91/CC dated 20.01.2024, with the request  to   analyze  the IP Address   of  instagram  account  having https://www.instagram.com/bamansaabb   Alisha   as   well   as https://www.instagram.com/aman  kumar ID of ID 22. Thus,   on   22.01.2024,   the   following   report   was   given   by   the Technical/Cyber Cell"- As   per   the   report   received   about   the   instagram   ID https://www.instagram.com/amankumar 2  which was being used by Accused Aman @ Jaanu. Three IP Addresses have been provided associated to the Instagram     ID  https://www.instagram.com/aman kumar 2 2 of Accused Aman @ Jaanu. The Time Corresponding to the IP addressed is in UTC (Co-ordinate Universal Time) format which have been changed into IST (Indian Standard Time) by adding 05:30 Hours, which is as follows:- IP Address 2409: 4055: 2dbb: 221: d541: cc07: 2ddf: 7a66 Time 2022-11-05 19:53:22 UTC UTC IST Difference (05.11.2022) (06.11.2022) 19:53:22 01:23 AM +5:30 Hours IP Address 2409: 4055: 2dbb: 221: d541: cc07: 2ddf: 7a66 Time 2022-11-05 20:02:14 UTC UTC IST Time (05.11.2022) (06.11.2022) Difference 20:02:14 01:32 AM +5:30 Hours IP Address 2409: 4055: 2e19: 11ati: 256a: cb4d: 955e: aba5 Time 2022-11-05 22:43:34 UTC (05.11.2022) (06.11.2022) Difference 22:43:34 04:13 AM +5:30 Hours The Emails  have been sent to respective Companies for getting information about these 03 I.P Addresses provided by Meta Platforms Business Record corresponding to letter No. 106/CC dated 22.01.2024 regarding the Instagram ID https://www.instagram.com/amankumar 22 used by accused Aman @ Jaanu. In the information about these 03 I.P Addresses corresponding to letter No.   106/CC   dated   22.01.2024   regarding   the   Instagram   ID https://www.instagram.com/aman  kumar 22 used by accused Aman @ Jaanu, it has been found that:- The First and the second IP Address are found to be same and it suggests that Aman @ Jaanu had logged-in his instagram ID on his cousin's phone namely Jyoti D/o Rattan Lal having mobile 98882-74719   on   dated  06.11.2022   at   00:32:02  Hrs   and   logged-out   at 02:32:02 Hrs. rdSimilarly, in regard to the 3   IP Address, accused Aman @ Jaanu again Logged-in his instagram ID having mobile No. 98882-74719 on dated 06.11.2022 at 04:01:53 Hrs and logged-out at 22:01:53 Hrs. On dated 06.11.2022 the accused Aman @ Jaanu had Logged-in and Logged-out his instagram ID on mobile no. 98882-74719 several times between 04:01:53 to 22:01:53 Hrs. The detail of Mobile No. 98882-74719 which was used by accused Aman @ Jaanu to login his instagaram ID, has been received and the same is found to be registered in the name of Jyoti D/o Rattan Lal R/o H.No.32 ward No. 33 Ghartholi Muhalla Pathankot. The said Jyoti is 1st cousin (Taya's daughter) of Aman @ Jaanu, who stays in the same house as that of petitioner. That further, on dated 05.11.2022 location of accused Aman @ Jaanu remained at the scene of crime till 23:24 Hrs after that he switched off his mobile phone 84372-14336 and logged-in his ID at 00:32 Hrs on

06.11.2022 using his cousin's namely Jyoti's mobile number 98882-74719..." The report of the Technical/Cyber Cell is attached as Annexure-11/T. That further the SIT has analyzed the call details/CDRs of Aman @ Jaanu, Alisha and Vinay Bains of 05.11.2022 i.e. the day of occurrence and it has been found that Aman @ Jaanu, Alisha and Vinay Bains were present at the place of occurrence i.e. Nawapul Abrol Nagar, Pathankot. However, as per previous statement dated 16.04.2023 of Vinay Bains which he deposed before the previous SIT, all 03 of them went together on the spot. That now again on carefully scrutiny of the Call Detail Record   (CDRs)   by   the   present   SIT   of   all   above   3   persons,   a contradiction can be seen in the technical evidence as well as the statement dated 16.04.2023 of Vinay Bains, because an SMS and a call are found to be done by Aman @ Jaanu to Alisha despite Alisha being there at the place of occurrence till 20:39 Hrs on 05.11.2022 as per call record. This raises suspicious questions which will be clarified during the further investigation. That on further scrutiny of CDRs, Aman @ Jaanu and Vinay Bains are found to be going towards village Bharoli Kalan, which suggests that they both had got together and have gone in search of Alisha upto the next bridge at Barfani Mandir or even further. This technical evidence cannot be ignored and the SIT is further analyzing the same, so that more evidence can come on record.

(iv) EFFORTS MADE ON 23.01.2024

(a) That on 23.01.2024, the reply to the letter No. 61/R dated

19.01.2024, whereby the volume and the depth of water in the canal on the date of occurrence i.e. 05.11.2022 was received on 23.01.2024 vide Letter  No.  98/4M  through SDO,  Head  Works  UBDC  Madhopur, Pathankot, as per which the depth of water of Canal could have varied from 2 feet to 5 feet approximately. It was also mentioned that where the Canal bridge/ ex-regulator structure and falls structures reaches then it may increase upto 9 feet. In the present case, the place of occurrence   is   next   to/under   the   bridge,   therefore,   there   is   all probability that the water would have been upto 9fts on the day of occurrence under the bridge. The copy of the relevant part of the reply received from the concerned department is attached as Annexure R-12.
