Order on Board 12/10/2026
¶1The brief facts of the case are that the petitioner, who was appointed as Lower Division Teacher on 01.12.1982 and subsequently promoted as Head Master, was transferred on
30.07.2012 to the Office of the Block Education Officer, Jashpur, but continued to discharge her duties at her original place of posting on the alleged oral directions of the authorities. She claims that her salary from August 2012 till her superannuation in January 2024, along with pensionary and other retiral benefits, has not been paid. Her claim for salary was rejected vide order dated 28.05.2024, which is under challenge in the present writ petition.
¶2At the outset, learned counsel for the petitioner submits that the petitioner seeks a direction to the respondent authorities to fix her pension and release all admissible pensionary and retiral benefits, including GPF and gratuity, along with the salary and other admissible benefits for the disputed period from 30.07.2012 to
22.05.2018, with interest. He, however, submits that in compliance with the order dated 19.08.2026 passed by this Court, the State has filed its reply, wherein, in paragraph 8, it has been stated that the pensionary benefits admissible to the petitioner in accordance with her actual qualifying service are being processed. He submits that the State has not specified the time within which the aforesaid benefits would be processed and, therefore, the present writ petition may be disposed of with an appropriate direction to the respondent authorities in this regard. He would further submit that, so far as the claim for salary for the period from 30.07.2012 to 22.05.2018 is concerned, the petitioner may be granted liberty to approach the appropriate forum at the appropriate stage.
¶3On the other hand, learned State counsel as well as learned counsel appearing for respondent No.4 have no objection to the aforesaid prayer.
¶4I have heard learned counsel for the parties and perused the material available on record.
¶5Considering the submissions made by learned counsel for the parties and considering the reply filed by the State, particularly the fact narrated at paragraph No.8 that the pensionary benefits admissible to the petitioner in accordance with her actual qualifying service are being processed, this writ petition is disposed of with a direction to the respondent authorities to complete the process of settlement and release of the pensionary benefits admissible to the petitioner in accordance with her actual qualifying service within a period of 100 days from the date of receipt of a copy of this order.
¶6So far as the petitioner's claim for salary and other admissible benefits for the period from 30.07.2012 to 22.05.2018 is concerned, liberty is reserved in her favour to approach the appropriate forum at the appropriate stage, in accordance with law.
¶7With the aforesaid directions and liberty, the writ petition stands disposed of. Sd/- (BIBHU DATTA GURU)
