Order on Board

13.10.2026

¶1Learned counsel for the petitioner submits that the petitioner's father, who was working as the Chief Municipal Officer, Nagar Panchayat Thankhamariya, District Bemetara, died on 12.10.2024. Thereafter, the petitioner submitted an application dated 26.11.2024 before respondent No. 4 seeking appointment on compassionate grounds. It is further submitted that the petitioner's application was taken up for consideration and, vide communication dated 04.12.2024, certain documents were sought from him. The Chief Municipal Officer also forwarded the matter to respondent No. 3, Joint Director, Urban Administration and Development, Durg, for necessary action. However, the petitioner's application for compassionate appointment has not been considered and decided till date. Learned counsel for the petitioner, therefore, prays for a direction to the concerned respondent authority to consider and decide the pending application within a stipulated period.

¶2Considering the submissions made by learned counsel for the petitioner and the fact that the application seeking compassionate appointment was submitted on 26.11.2024, within the prescribed period following the death of the petitioner's father, this Court is of the view that the grievance raised by the petitioner can be redressed by directing the competent authority to take a decision on the pending application. Accordingly, without expressing any opinion on the merits or entitlement of the petitioner to compassionate appointment, respondent No. 4 is directed to consider and decide the petitioner's application dated 26.11.2024, in accordance with the applicable rules and policy, by passing a reasoned and speaking order, within a period of 50 days from the date of receipt of a copy of this order.

¶3The petitioner shall be at liberty to place a copy of this order along with a copy of the application dated 26.11.2024 and relevant supporting documents before respondent No. 4 to facilitate compliance with the direction issued by this Court.

¶4It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim for compassionate appointment, and the competent authority shall consider the same independently in accordance with law.

¶5With the aforesaid directions, the writ petition stands disposed of. Sd/-
