Order on Board
13.10.2026
¶1This MCC has been filed for restoration of WPS No. 6861 of 2026, which came to be dismissed for want of prosecution vide order dated 21.09.2026.
¶2Learned counsel for the applicant submits that the aforesaid writ petition was listed for hearing on 21.09.2026. However, when the matter was called out, learned counsel for the petitioner could not appear before this Court as he was engaged in proceedings before another Bench of this Court. Consequently, the writ petition came to be dismissed for want of prosecution.
¶3It is further submitted that the non-appearance of learned counsel was neither intentional nor deliberate, but occurred due to the aforesaid circumstances. The absence was bona fide and inadvertent, and the applicant has no intention of abandoning the proceedings. Learned counsel, therefore, prays that the order dated 21.09.2026 be recalled and WPS No. 6861 of 2026 be restored to its original number.
¶4I have heard learned counsel for the applicant and perused the material available on record.
¶5Considering the facts and circumstances of the case and the explanation furnished by learned counsel for the applicant, this Court is satisfied that sufficient cause has been shown for restoration of WPS No. 6861 of 2026. The non-appearance of learned counsel appears to have been bona fide and unintentional.
¶6Accordingly, this MCC is allowed, subject to payment of costs of Rs. 2,000/- (Rupees Two Thousand only) by the applicant in the Chhattisgarh High Court Bar Association Library Fund.
¶7Upon deposit of the aforesaid costs, the order dated
21.09.2026, whereby WPS No. 6861 of 2026 was dismissed for want of prosecution, shall stand recalled, and WPS No. 6861 of 2026 shall be restored to its original number.
¶8The MCC stands disposed of accordingly. Sd/-
