Order on Board 15/10/2026
¶1This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.187/2026 registered at Police Station Pusaur, District Raigarh (C.G.), for the offence punishable under Sections 296, 115(2) and 309(4) of Bhartiya Nyay Sanhita, 2023 (for short, the BNS, 2023).
¶2As per the case of the prosecution, the complainant Kamal Prashad Jangde lodged a written report at P.S. Pusaur to the effect that when he was returning from Raigarh on his Scooty, at about 10:20 pm, three unknown persons dashed his Scooty, due to which, he fell down, Digitally signed by ALLENA ANJANI KUMAR Date: 2026.10.16 +0530 thereafter they abused him and assaulted by means of hands and fists and subsequently, they looted his purse, in which, cash of Rs.2500/- was there, ATM card, Adhar Card, Voter ID Care and Driving License are also kept in purse. Further, they also looted his mobile phone and ran away. During course of investigation, applicant and other accused persons have been arrested. Thereafter, the police registered the offence as stated above.
¶3Learned counsel for the applicant would argue that one criminal case under the provision of IPC was registered in the year 2018 and one case under Gambling Act is also pending since 2025. He would further submit that applicant has falsely been implicated in the case; charge-sheet has already been filed and the applicant is in jail since
12.07.2026 and conclusion of the trial is likely to take some considerable time. Therefore, he would pray that the bail application may be allowed and the applicant may be enlarged on bail.
¶4On the other hand, learned counsel for the State would oppose the submissions advanced by the learned counsel for the applicant. She would submit that present applicant along with two other accused-persons committed loot of mobile phone, cash of Rs.2500/-, ATM Cards. She would submit that in Test Identification Parade, the applicant has been identified by the complainant and there are two criminal antecedents against him, therefore, the bail application deserves to be rejected.
¶5I have heard learned counsel appearing for the parties and perused the case diary.
¶6Having considered the fact that one case under the provision of IPC was registered way back in the year 2018 and another case under Gambling Act was also registered in the year 2025; charge-sheet has already been filed; the applicant is in jail since 12.07.2026 and conclusion of trial may take some considerable time, without making any observation on merits of the matter, I am inclined to grant bail to the applicant. Accordingly, the instant bail application is allowed.
¶7It is directed that the applicant shall be released on bail on his furnishing a personal bond in sum of Rs.50,000/-with one surety in the like sum to the satisfaction of the Court concerned with the following conditions:-
(i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court;
(ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, &
(iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
¶8The observation made herein above is for the purpose of deciding this bail application only and the trial Court shall decide the case on its own merits. Sd/-
