¶1This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 76/2026 registered at Police Station Kabir Nagar, District Raipur (C.G.), for the offence punishable under Sections 137(2), 87, 64(2)(m), 65(1) of BNS and Sections 4(2), 5(L) & 6 of POCSO Act.
¶2As per case of prosecution on 16.01.2025, the applicant, Shobhit Sen took victim aged about 14 years to his house and forcibly established physical relations with her. He repeatedly forced her to have physical relations with him against her will On 12.03.2026, he again committed the same act when SIDDHANT TAMRAKAR Date: 2026.10.16 17:52:47 +0530 the victim was alone at home. On 08.04.2026, the victim disclosed the incidents to her mother, who lodged an FIR against the applicant.
¶3Learned counsel for the applicant would submit that the applicant has falsely been implicated in the present case on account of prior enmity and family disputes between the parties. He would further contend that the applicant is a daily wage labourer and sole breadwinner of his family, he is in jail since
09.04.2026, he has no criminal antecedent, and trial is likely to take some time. He would pray for grant of bail to the applicant.
¶4On the other hand, learned counsel for the State would oppose the bail application and submit that on the date of incident age of the victim was 14 years and there are serious allegations with regard to sexual assault in statement of victim recorded under Section 183 of BNSS. She would contend that victim has been examined before the learned Trial Court and she has supported the case of prosecution. She would submit that instant application deserves to be rejected.
¶5I have heard learned counsel appearing for the parties and perused the case diary.
¶6Having considered the nature and gravity of allegations and material available on record, and fact that on the date of incident victim was aged about 14 years, she has already been examined before the learned Trial Court and she has supported the case of prosecution, wherein she has categorically stated that on 16.01.2025, the present applicant forcibly subjected her to sexual intercourse against her will. She has further stated that the applicant threatened to defame her in the village if she disclosed the incident to anyone.
¶7Having considered the allegations made against the present applicant in statements recorded under Sections 180 and 183 of BNSS, statement of the victim before the learned Trial Court and age of the victim, I am not inclined to allow this application.
¶8Accordingly, instant bail application is hereby rejected. Sd/-
