Order on Board 16/10/2026
¶1This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.103/2026 registered at Police Station Lalpur, District Mungeli (C.G.), for the offence punishable under Sections 318(4), 338, 336(3), 340(2), 3(5) of Bhartiya Nyay Sanhita, 2023 (for short, the BNS, 2023).
¶2As per the case of the prosecution, on 27.06.2026, an F.I.R. was lodged to the effect that co-accused Deepak, a resident of Haryana allegedly obtained a forged domicile certificate of village Chandali, District Mungeli and got employment in Indo-Tibetan Border Police. During verification, it surfaced that the said Deepak is not resident of village Chandali. The allegation against the present applicant is that he Digitally signed by ALLENA ANJANI KUMAR Date: 2026.10.16 +0530 assisted the said Deepak in getting the forged document and also assisted him in the verification process. On the basis of such allegation, the offence, as stated above, has been registered against the present applicant.
¶3Learned counsel for the applicant would submit that the applicant has falsely been implicated in the case; the allegation against the present applicant is that he had advised the main accused Satyapal Malik to approach the Naresh Lahrey. He would submit that the present applicant is not involved in fabrication of the documents. It is also contended that co-accused Naresh Lahrey has already been enlarged on bail by order dated 26.09.2026 passed in MCRC No.8303/2026. He would submit that the applicant has no criminal antecedents; the applicant is in jail since 26.06.2026; charge-sheet has already been filed and conclusion of the trial is likely to take some considerable time. Therefore, he would pray that the bail application may be allowed and the applicant may be enlarged on bail.
¶4On the other hand, learned counsel for the State would oppose the submissions advanced by the learned counsel for the applicant. He would submit that the present applicant and other co-accused persons have fabricated domicile certificate, which was used to secure public employment, therefore, the bail application deserves to be rejected.
¶5I have heard learned counsel appearing for the parties and perused the case diary.
¶6Having considered the fact that the applicant has no criminal antecedent; charge-sheet has already been filed; the applicant is in jail since 26.06.2026; co-accused Naresh Lahrey has already been granted bail by order dated 26.09.2026 passed by this Court in MCRC No.8303/2026 and the applicant was not involved in fabrication of forged domicile certificate and further considering conclusion of trial may take some considerable time, I am inclined to grant bail to the applicant. Accordingly, the instant bail application is allowed.
¶7It is directed that the applicant shall be released on bail on his furnishing a personal bond in sum of Rs.50,000/-with one surety in the like sum to the satisfaction of the Court concerned with the following conditions:-
(i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court;
(ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, &
(iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
¶8The observation made herein above is for the purpose of deciding this bail application only and the trial Court shall decide the case on its own merits. Sd/-
