Judgment
Order on Board 16/10/2026
¶1This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.103/2026 registered at Police Station Lalpur, District Mungeli (C.G.), for the offence punishable under Sections 318(4), 338, 336(3), 340(2), 3(5) of Bhartiya Nyay Sanhita, 2023 (for short, the BNS, 2023).
¶2As per the case of the prosecution, the allegation against the present applicant is that he secured forged domicile certificate and further got Digitally signed by ALLENA ANJANI KUMAR Date: 2026.10.16 +0530 appointment on the post of Constable in Indo-Tibetan Border Police. During the course of verification of the document, it was found that no such domicile certificate was issued in favour of the applicant and that, the said certificate was found fabricated and forged one. On the basis of such allegation, the offence, as stated above, has been registered against the present applicant.
¶3Learned counsel for the applicant would content that the applicant is permanent resident of village Lalpur; domicile certificate was issued by the competent authority in his favour and it has not been verified by the competent authority. He would contend that charge-sheet has already been filed; he is in jail since 27.06.2026 and he is a Government servant and further conclusion of the trial is likely to take some considerable time. Therefore, he would pray that the bail application may be allowed and the applicant may be enlarged on bail.
¶4On the other hand, learned counsel for the State would oppose the submissions advanced by the learned counsel for the applicant. He would submit that the present applicant is a beneficiary. It is also contended that representing himself as the resident of Lalpur village, District Mungeli, he obtained such certificate and secured employment to the post of Constable in ITBP. He would submit that the applicant adopted fraudulent methods to obtain the domicile certificate in his favour, therefore, the bail application deserves to be rejected.
¶5I have heard learned counsel appearing for the parties and perused the case diary.
¶6Having considered the allegation against the present applicant that he fabricated domicile certificate and secured employment in ITBP on the post of Constable and that, he is a beneficiary and further taking into consideration the allegation against him, I am not inclined to grant bail to the applicant. Accordingly, the instant bail application is rejected. Sd/-
