¶1This second appeal has been preferred by the appellant/plaintiff-Ram Kishore Agrawal under Section 100 of the Code of Civil Procedure, 1908 (for short the "CPC") feeling aggrieved by judgment and decree dated 07.07.2009, passed by the first appellate Court in CA No.10-A/2018 (Ram Kishore v. Smt. Raj Kumari and others), by which his first appeal challenging the judgment and decree dated 24.12.2007, passed by the learned trial Court in CS No.34-A/2007 (Ram Kishore v. Smt. Raj Kumari and others), has been dismissed.

¶2It transpires from the record of the case that on the last date of listing of this matter i.e. on 15.09.2026, fixed date SPC was issued to the appellant for making arrangement for his representation in the matter. However, as per office report dt. 13.10.2026, the said SPC issued on 17.09.2026 returned unserved with an endorsement that the house mentioned in the address of the appellant is vacated and he has moved somewhere else. Today also, there is no representation on behalf of the appellant even in the passover round.

¶3Under such circumstances, the Court is left with no other option but to dismiss this appeal for want of prosecution. It is ordered accordingly. sd/-
