¶4THE THASILDAR HOSKOTE TQ HOSKOTE - 562 114. …RESPONDENTS (BY SRI. NAVYA SHEKHAR, AGA)

THIS WP IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT OF MANDAMUS TO THE THIRD RESPONDENT TO REMOVE THE BOARD PUT UP ON THE LAND IN QUESTION PRODUCED AT ANNEXURES-D1 TO D10 AND RESTORE THE LAND INTO THE ORIGINAL POSITION AS IT WAS IN EXISTENCE PRIOR TO

31.07.2021 AND ETC.

THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER The grievance of the petitioner is that the respondent Tahsildar, Hoskote Taluk has put up a board stating that the land in question namely 2 acre 16 guntas in Sy.No.94 of Kannamangala Village, K.R.Puram Hobli, Bangalore East Taluk, belongs to the Government. The first prayer in the writ petition is to direct the Tahsildar to remove the board. The second prayer is to issue a writ of mandamus directing the respondent

Tahsildars to enter the name of the petitioner's husband in the revenue records since the lands in question were regularised in favour of the petitioner's husband who was in unauthorised cultivation of the same, after the petitioner's husband paid the upset price in the year 1978. It is the contention of the petitioner that pursuant to the grant a Saguvali Chit as found at Annexure-B was issued in favour of the petitioner's husband on

14.12.1979 and the revenue records were also entered in the name of the petitioner's husband.

¶2During the course of these proceedings, the respondent - Tahsildar was directed to file an affidavit having regard to the contentions raised by the petitioner. Accordingly the Tahsildar, Bangalore East Taluk, K.R.Puram filed an affidavit dated 12.01.2022 stating that the lands in question are classified as 'Sarkari Thopu' and the petitioner is a total stranger to the lands in question. Since the petitioner was claiming that the land belongs to the petitioner, a board has been erected on the lands in question on 02.08.2021.

¶3Having regard to the facts obtained herein above, the writ petition stands disposed of with a direction to the

respondent - Tahsildar, Bangalore East Taluk, to verify from the records regarding the genuineness of the claim made by the petitioner. The original Grant Register, Saguvali Chit Issue Register and the Mutation Register shall be verified in the presence of the petitioner. If it is found that the claim made by the petitioner is genuine, the Tahsildar shall proceed to enter the name of the petitioner's husband in the revenue records, as expeditiously as possible and at any rate within a period of 2 months from the date of receipt of a copy of this order. On the other hand if it is found that the claim of the petitioner is found to be incorrect, necessary endorsement may be issued to the petitioner. Sd/- (R DEVDAS) JUDGE GPG List No.: 1 Sl No.: 32
