ORAL ORDER
In this writ petition, the petitioner is challenging the action of the respondent No.2-University in barring the petitioner from entering into the respondent No.2-University premises in compliance with the direction issued by this Court in Writ Petition No.32079 of 2025 (Annexure-M).
¶2Heard Sri. Subramanya S. Upasana, learned counsel appearing for the petitioner; Sri. Showri H.R., learned counsel appearing for the respondent No.1; Sri. Somashekar, learned counsel appearing for respondents 2 to 4; and Sri. Thilak Raj S.V., learned counsel appearing for the respondent No.5.
¶3Sri. Subramanya S. Upasana, learned counsel appearing for the petitioner invited the attention of the Court to the decision taken by the respondent No.3-Student Disciplinary Committee at Annexure-E and submitted that the said Committee had condoned the allegations made against the petitioner by issuing a warning to the petitioner for alleged acts of indiscipline in the respondent No.2-Univesity. Learned counsel further submits that, in furtherance of the warning
issued by the respondent No.3-Committee, the petitioner has not misbehaved with anyone much less the respondent No.5 herein, however, the respondent No.2-Univesity barred the petitioner from entering into the premises of the respondent No.2-University. Accordingly, he sought for interference of this Court.
¶4Per contra, Sri. Somashekar, learned counsel appearing for respondents 2 to 4 refers to the Annexure-R3K and submitted the conduct of the petitioner herein has been followed and video clips shows that the petitioner continued to be misbehaved with the respondent No.5 and therefore, the action has been taken against the petitioner.
¶5Sri. Thilak Raj S.V., learned counsel appearing for the respondent No.5 submits that the endeavour has to be made to protect the interest of the respondent No.5. Accordingly, he sought for dismissal of the petition.
¶6In the light of the submission made by learned counsel appearing for the parties, on perusal of the decision taken by the respondent No.3-Committee particularly at Annexure-E, would indicate that the petitioner and his parents
have visited the respondent No.2-Univesity and assured with an undertaking that the petitioner herein will not misbehave with the respondent No.5 and accordingly, the respondent No.3-Committee condoned the misbehaving character of the petitioner with the respondent No.5. On perusal of the order dated 07th November, 2025 (Annexure-M) passed in Writ Petition No.32079 of 2025, the same would indicate that, this Court directed the respondent No.3-Committee to consider the reply that may be made by the petitioner and to take decision in the matter. In compliance of the order passed by this Court, the respondent No.3-Committe passed an impugned order dated 22nd December, 2025 (Annexure-N), wherein the petitioner was permanently barred from entering into the respondent No.2-University. Perusal of the records would indicate that, there is no material before the respondent No.2-University to take decision against the petitioner pursuant to condonation of the misbehaving activities of the petitioner after the decision taken by the respondent No.3-Committee as per Annexure-E. In that view of the matter, impugned order dated 22nd December, 2025 (Annexure-N) passed by the respondent No.3-Committee and the Appellate order passed by the
respondent No.4-Vice Chancellor produced at Annexure-S are hereby quashed. However, in order to protect the interest of the respondent No.5, the petitioner is directed to file an affidavit before this Court stating that, he will abide by the regulations of the respondent No.2-University and he shall not interfere with the respondent No.5 henceforth. The said affidavit shall be filed by the petitioner within one week from the date of receipt of this order. In the result, writ petition is allowed.
¶7In view of allowing the writ petition, the respondent No.2-University shall allow the petitioner to pursue the *B-Tech(Hons.)degree in the respondent No.2-University as per their rules and regulations.
