THIS WP IS FILED UNDER ARTICLE 226 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT OF CERTIORARI OR ANY OTHER WRIT OR ORDER OR DIRECTION QUASHING THE IMPUGNED NOTICE DATED 20-12-2025 ISSUED BY RESPONDENT NO.2 IN ITS PROCEEDING NO.NCR/CR/06/24-25 VIDE ANNEXURE-D AND ETC.,

THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

by CHANDANA B M Location: High Court of Karnataka

CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR

ORAL ORDER

In this petition, the petitioner seeks the following reliefs: "a) Issue a writ of certiorari or any other writ or order or direction quashing the impugned notice dated 20.12.2025 issued by respondent No.2 in its proceeding No.NCR/CR/06/24-25 vide Annexure-d,.

b) Issue writ of mandamus or any other writ or order or direction, directing respondent No.2 to dispose of the application filed by the petitioner as per No.BHM397ffaf536cfr1 dated

05.02.2019 vide ANNEXURE-B within the time fixed by this Hon'ble Court and

c) Grant such other and further reliefs as this Hon'ble Court deems fit under the circumstances of the case in the interest of justice."

¶2Heard learned counsel for the petitioner and learned AGA for the respondents and perused the material on record.

¶3A perusal of the material on record will indicate that it is a specific contention of the petitioner that he filed an application before respondent No.2-Tahsildar seeking regularisation of unauthorised occupation of the petitioner in relation to the subject property and respondent No.2 issued acknowledgment (Annexure-B) dated 05.02.2019 for receipt of application for regularization of land and he also produced a

copy of register maintained by respondent No.2 for receipt of application for regularization of land (Annexure-C). It is the grievance of the petitioner that without considering the aforesaid application, the respondents have instead issued the impugned notice at Annexure-D dated 20.12.2025 calling upon the petitioner to remove the alleged encroachment and as such, the petitioner is before this Court by way of the present petition.

¶4Per contra, learned AGA submits that if reasonable time is granted, the concerned respondent would consider the application filed by the petitioner for regularisation of unauthorised occupation and take appropriate decision/pass appropriate orders in accordance with law.

¶5In view of the aforesaid facts and circumstances and the material on record which discloses that the application for unauthorised occupation has not been considered by the respondents even till today, I deem it just and appropriate to dispose of this petition directing the concerned respondent to consider and take appropriate decision/pass appropriate orders on the application filed by the petitioner within a period of three

months from the date of receipt of a copy of this order. It is further directed that till the concerned respondent takes appropriate decision/passes appropriate orders as stated supra, the respondents shall not take any precipitative/coercive steps/action against the petitioner pursuant to Annexure-D dated 20.12.2025.

¶6Subject to the aforesaid directions and reserving liberty in favour of the petitioner to take recourse to such remedies as available in law including approaching this Court subsequently, the petition stands disposed of.
