ORAL ORDER
Accused in S.C.No.799/2025 pending before the Court of 28th Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.51/2025 registered by HAL Police Station, Bengaluru, for offences punishable under Sections 109, 121(1), 132, 352, 351(2) and 121(2) of BNS, 2023 and Section 25-1(B)(b) of Arms Act, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
¶2Heard the learned counsel for the parties.
¶3FIR in Crime No.51/2025 was registered by HAL Police Station, Bengaluru for offences punishable under Sections 109, 121(1), 132, 352 of BNS, 2023 and Section 25-1(B) (b) of Arms Act, against the petitioner herein based on the first information dated 31.01.2025 received from Mr.Sunil Kumar, police constable attached to the HAL Police Station. In the said case, petitioner was arrested on 31.01.2025 and
subsequently, remanded to judicial custody. After completing investigation, charge sheet is filed against the petitioner for the said offences. Bail application filed before the jurisdictional Sessions Court was rejected in S.C.No.799/2025, therefore, is before this Court.
¶4Perusal of the material on record would go to show that on the alleged date of incident, the first informant and another police constable by name Ashok, allegedly had gone to apprehend the petitioner herein, as against whom, NBW was issued in S.C.No.1515/2021 by the jurisdictional Sessions Court. It is alleged that when the police constable after showing the ID card, attempted to apprehend the petitioner, he allegedly took out the dragger and after threatening, assaulted them with the same, causing injuries. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences.
¶5The material on record would go to show that the petitioner had also suffered certain injuries on him and he had taken treatment for the same in Bowring hospital at Bengaluru.
He was accompanied by police to the said hospital. The first informant and the other injured had taken treatment for their injuries in the private hospital at Tippasandra, Bengaluru. it is not in dispute that the police constable along with the first informant has suffered simple injuries. In the would certificate of the first informant, though it is mentioned that there are grievous injuries, the medical officer has not specified the particulars of injury which is certified as grievous. Be that as it may, fact remains that the police constables have not suffered any injuries on vital part of their body. The petitioner is in custody in the present case for the last more than one year and six months. In the other criminal case which is registered against him, he has been enlarged on bail.
¶6Considering the nature of allegations found against the petitioner in the present case, who is in custody for the last one year six months, I am of the opinion that prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following;
O R D E R
(i) The petition is allowed.
(ii) The petitioner is directed to be enlarged on bail in Crime No.51/2025 registered by HAL Police Station, Bengaluru, registered for offences punishable under Sections 109, 121(1), 132, 352, 351(2) and 121(2) of BNS, 2023 and Section 25-1(B)(b) of Arms Act, subject to the following conditions:

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
