¶2THE TAHSILDAR KANAKAPURA TALUK OFFICE KANAKAPURA, RAMANAGARA DISTRICT 562 117. …RESPONDENTS (BY SMT. NAVYA SHEKAR, AGA)

THIS W.P. IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT IN THE NATURE OF MANDAMUS, OR ANY OTHER APPROPRIATE WRIT OR DIRECTION, COMMANDING R2 THE TAHSILDAR, KANAKAPURA TALUK TO CONSIDER AND DISPOSE OF THE PETITIONERS' REPRESENTATION DATED

08.09.2025 ANNEXURE-D FOR THE TRANSFER OF KHATA FOR THE SCHEDULE PROPERTY.

THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate is directed to take notice for both respondents.

¶2It is the contention of the learned counsel for the petitioners that Sri.Thimmegowda, father-in-law of petitioner No.1 and grandfather of petitioner Nos.2 to 4 purchased the petition schedule properties measuring 6 guntas in Sy.No.28/3 (New No.28/3b), 13 guntas in Sy.No.41/1 and 11 guntas in Sy.No.41/8, all situated at Udharehalli village, Kasaba Hobli, Kanakapura Taluk, Ramanagara District (now known as

Bengaluru South District) under registered Sale Deed dated

31.05.1965. The name of Sri.Thimmegowda was entered in the revenue records, after his death name of his wife Smt.Lingamma was entered in the revenue records. However, after computerization, the name of Smt.Lingamma has not been continued in the revenue records. Therefore, petitioners have given representation to the Tahsildar at Annexure-D dated

08.09.2025 seeking to enter the names of the petitioners who have succeeded to the estate of late Sri.Thimmegowda. However, the Tahsildar has not considered the representation and has not passed any orders.

¶3After hearing the learned counsel for the petitioners, the learned Additional Government Advocate and on perusing the petition papers, this Court finds from the material on record that the name of the petitioner was earlier entered in the land revenue records. However, if the Tahsildar is of the opinion that the petitioner has not been granted lands, nevertheless, it is the duty of the Tahsildar to secure the original grant records, Saguvali Chit issue register and other contemporaneous records to

satisfy himself regarding the grant made in favour of the petitioner. Moreover, there is no reason why the name of the petitioner which was earlier entered in the land revenue records has been continued after computerization, the Tahsildar is duty bound to look into all these aspects and pass necessary orders.

¶4Consequently, this writ petition stands disposed of with a specific direction to respondent No.2 - Tahsildar, Kanakapura Taluk to consider the representation given by the petitioners and in the light of the observations made hereinabove, verify the original records in the presence of the petitioners and pass necessary orders to enter the name of Smt. Lingamma in the computerized RTC and land revenue records as expeditiously as possible and at any rate within a period of two months from the date of receipt of copy of this order. Thereafter, the Tahsildar shall verify if the petitioners are the legal heirs of Smt.Lingamma, issue notice, hear all concerned parties. Thereafter, if it is found out that the petitioners are the legal heirs of Smt.Lingamma, the Tahsildar shall proceed to

enter the names of the petitioners with all other legal heirs as the case may be in accordance with law.

¶5Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today. Sd/- (R DEVDAS) JUDGE GPG List No.: 1 Sl No.: 23
