THIS WRIT APPEAL IS FILED UNDER SECTION 4 OF THE KARNATAKA HIGH COURT ACT, 1961, PRAYING TO, APPELLANTS TO THIS HON'BLE COURT THAT ORDER DATED 8/5/2025 PASSED IN WRIT PETITION NO.103118/2025 PASSED BY THE LEARNED SINGLE JUDGE MAY MODIFIED BY ALLOWING THIS APPEAL IN THE INTEREST OF JUSTICE AND EQUITY.

THIS WRIT APPEAL, COMING ON FOR PRELIMINARY HEARING THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER:

CORAM: THE HON'BLE MR. JUSTICE M.I.ARUN AND THE HON'BLE MR. JUSTICE B. MURALIDHARA PAI

ORAL JUDGMENT (PER: THE HON'BLE MR. JUSTICE M.I.ARUN)

¶1The appellants have challenged the appointment of an Administrator to manage the affairs of a Wakf in writ Petition No.103118 of 2025. Learned Single Judge, after hearing the petitioners, ordered emergent notice but has refused to grant any interim order staying the appointment of the Administrator. The said order was passed on 08.05.2025. Aggrieved by the same, the present appeal is filed.

¶2This Court, by its order dated 13.05.2025, has passed an interim order staying the appointment of the Administrator.

¶3Learned counsel appearing for respondents submits that, in spite of the learned Single Judge ordering emergent

notice, the petitioners have not taken any steps to have the respondents served in Writ Petition No.103118 of 2025. He further submits that he would file the necessary vakalath before the learned Single Judge by the next date of hearing, all by himself, irrespective of whether the appellants take necessary steps to have the respondents served or not in the writ petition.

¶4Learned counsel for the respondents further submits that, in light of his undertaking to file vakalath before the learned Single Judge, the writ appeal may be disposed of, reserving liberty to the parties to agitate their claims before the learned Single Judge.

¶5Learned counsel for the appellants is agreeable for the same. However, he submits that the interim order passed by this Court may be continued for a few days to enable the parties to move the necessary application before the learned Single Judge in respect of the interim prayers. Hence, the following: ORDER The Writ Appeal is hereby disposed of, reserving the liberty to the parties to agitate their rights in Writ Petition No.103118 of 2025. The

interim order granted by this Court on 13.05.2025 shall continue for a period of 30 days or until such orders are passed by the learned Single Judge in the Writ Petition.
