Judgment

ORDER (Order of the Court was made by S.M.Subramaniam J.) The order of rejection for revision of pay by the Accountant General of Tamil Nadu in proceedings dated 13.06.2023 is under challenging in the present writ petition.

¶2The writ petitioner was appointed as Junior Bailiff in the year 1965 and retired as Special Grade Process Server on 31.01.2003. Admittedly, he is receiving pension for the past about 26 years. Suddenly, he submitted a representation, after a lapse of more than two decades from his date of retirement stating that he is eligible for revision of pay. The representation was forwarded by the District Munsif, Tiruvarur, to the Accountant General of Tamil Nadu, vide proceedings dated 12.05.2023. The Accountant General of Tamilnadu, returned the proposal submitted by the District Munsif on the ground that as per G.O.No.666, the time scale of pay for Junior Bailiff was 505-845 which was revised as 800-1150. As per G.O.304 Selection grade time scale corresponding to the ordinary grade scale of pay is 950-1500 and Page3 of 5 Special Grade is 975-1660. In Column '3' of Annexure 1 in G.O.304, there is no scale of pay of 1400 -2600 for any of the ordinary grade time scale.

¶3The claim set out by the writ petitioner for revision is to the scale of pay 1400-2600. Since the Government Orders does not permit any such revision, the Accountant General, rejected the same. Further, the Accountant General has stated that if at all any grievance exists in respect of the pensioner, a proposal must be sent through proper channel i.e., Registrar General, High Court, Madras. Based on the proposal submitted by the District Munsif, the pay revision of a retired employee cannot be done. This Court does not find any infirmity in respect of the order impugned passed by the Accountant General of Tamil Nadu. However, if any grievance still exists to the petitioner, he is at liberty to approach the competent authority and its correctness is to be verified by the Registrar General, High Court, Madras, before forwarding the same to the Accountant General of Tamilnadu. Accordingly, the Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.)
