Judgment
JUDGMENT (Judgment of the Court was delivered by S.M.Subramaniam J.) The present writ appeal has been instituted to challenge the writ order dated 19.01.2024 in W.P.No.1200 of 2024.
¶2Writ petitioner is the appellant. The report of the committee dated
31.08.2022, as modified subsequently on 17.09.2022 is under challenge in the writ petition and consequential relief is sought for to pay monthly benefits due to the petitioner as per his representation dated 17.02.2023.
¶3Writ Court considered the fact that appellant was served with show-cause notice, and de-promoted to the post of Clerk with effect from
09.05.2011. It was challenged before this Court in W.P.No.14383 of 2014 and was dismissed by order dated 31.01.2019. The order of the Writ Court was confirmed by the Division Bench in WA.No.1818 of 2019. Thereafter, appellant submitted a representation to settle the arrears of wages and other monetary benefits with interest. Since it was not considered, again the appellant filed W.P.No.,11170 of 2021, and this Court directed the Joint Registrar of Cooperative Societies to consider the representation submitted by the appellant and pass appropriate orders. ¶4A Committee was constituted, and committee made a recommendation for payment of provident fund, gratuity and other monetary benefits due to the appellant along with interest.
¶5Mr.M.S.Palaniswamy, learned counsel for the 3rd respondent would submit that said benefits had already been settled on 13.02.2023.
¶6Despite the settlement of the terminal benefits, learned counsel for the appellant would mainly contend that calculation of arrears is erroneous, and in this regard, representation was submitted to the Society, which is yet to be considered.
¶7Learned counsel for the respondent would submit that representation, if any submitted, would be looked into in order to ascertain if any error crept in during effecting re-fixation of pay.
¶8If at all, error is identified, the same shall be rectified. Appellant is permitted to approach the competent authorities to establish the error, if any, in his opinion. Page4 of 5
¶9With the above observation, the writ appeal stands disposed of. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. (S.M.S.,J.) (R.S.V.,J.) 25-06-2026 Index: Yes/No Speaking/Non-speaking order GD To
