Judgment
ORDER (Order of the Court was made by S.M.Subramaniam J.) The present writ petition has been instituted challenging the Audit Slip No.1 issued by the Internal Audit Wing of Madurai Bench of Madras High Court, addressed to the Sessions Judge, Fast Track Mahali Court, Theni.
¶2The petitioner is working as Junior Assistant in Sessions Court, Mahaleer Neethimandram, Fast Track Mahila Court, Theni. He was appointed on compassionate ground on 25.06.2015 and posted as Examiner in the Chief Judicial Magistrate Court, Theni. He joined duty on 29.06.2015. His pay was fixed and the Internal Audit Wing of Madurai Bench of Madras High Court found that there was no error in pay fixation and raised certain objections in Audit Slip No.1 which was addressed to the Sessions Judge, Fast Track Mahila Court, Theni. The copy of the Audit Slip was not communicated to the writ petitioner, but the said Audit Slip is under challenge in the present writ petition.
¶3The Audit Slip per se would not provide a cause for instituting a writ proceedings. Audit Slip has been issued by Internal Audit Wing addressed to Page3 of 4 the Sessions Judge, who in turn, has to consider the same and thereafter, take an appropriate decision. It is not made clear how such an Internal Audit Slip issued by the Team Head of the Internal Audit Wing addressed to Sessions Judge, Theni, was made available to the petitioner. In this regard, the learned Principal District Judge, Theni, is directed to conduct an enquiry and initiate appropriate action, if required.
¶4As far as the writ petition is concerned, based on the Audit Slip, it appears that no action was taken. Thus, the said Audit Slip will not provide any cause of action for filing a writ petition. The writ petition is not entertainable. Therefore, the Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed. (S.M.S.,J.)
