Bench

Case no.
WP Crl. 1598/2026

Judgment

Order (Order of the Court was made by Dr.Anita Sumanth J.) The petitioner is the wife of a convict lodged in Central Prison, Coimbatore. The convict has been granted ordinary leave of 21 days though with escort and the present petition is filed as the petitioner and convict are aggrieved by the imposition of condition relating to escort.

2.Mr.C.R.Malarvannan, learned counsel for the Government of Tamil Nadu (Criminal Side) states that the condition has been imposed as this is a first time the convict is availing leave and hence is a matter of policy, the authorities prefers that an escort is provided.

3.However, learned counsel for the petitioner would submit that the leave has been sought to attend the medical condition of the petitioner's wife.

¶4Hence, to balance the interests of both parties and since the reports of the police and probation officer are in favour of the convict and most importantly, since Mr.Malarvannan, does not very seriously object to the removal of the condition made for escort, we modify order dated 03.02.2026 and confirm the grant of leave though without escort. The convict shall report before the Inspector of Police, Erode Taluk Police Station, every day between 4.00 p.m. to 5.00 p.m., during the period of leave and shall abide by all the conditions prescribed in the Jail Manual.
