Judgment

ORDER (Order of the Court was made by Dr.Anita Sumanth J.) We have heard Mr.M.Mubeen, learned counsel for petitioner and Mr.C.R.Malarvannan, learned Counsel for Government of Tamil Nadu (Crl. Side) for respondents.

2.The petitioner has sought 30 days emergency leave without escort for her son Sarangabani who is a convict in Central Prison-I, Puzhal, Chennai. The representation has come to be dismissed by way of impugned order dated

09.06.2026 and the authority appears to have been swayed by the fact that the representation was for 30 days emergency leave which is not provided for under the Rule.

3.While that may be true, the reasons cited in the leave application are that the mother of the convict is suffering from medical ailments and the presence of the convict is needed to attend the same. Finding the reason legitimate, as records are placed before us that indicate that the petitioner is suffering from cervical cancer, we are inclined to grant leave. Having said so, we find no infirmity in the impugned order as, there is no provision for leave of Page3 of 4 30 days under Rule 6 of the Tamil Nadu Suspension of Sentence Rules, 1982.

4.We direct R2 to re-look into the representation and consider grant of emergency leave on the basis of the reasons set out in the representation and communicate the decision of the authority to the petitioner and convict within a day of disposal of representation.

¶5Let orders be passed within a week from today. This writ petition stands disposed. No costs. (A.S.M.,J.) (S.M.,J.) 14-07-2026 Index: Yes/No Speaking DP To
