Order (Order of the Court was made by Dr.Anita Sumanth J.) The father of the convict Siva @ Sivakumar, confined in Central Prison, Salem seeks pre-mature release of his son on the basis of medical grounds as the convict is diagnosed HIV positive and his health condition is stated to be serious.

¶2The petitioner has filed a petition dated 03.07.2026 before the respondents seeking remission in terms of Chapter XIX of the Tamil Nadu Prison Rules, 2024, whereunder, Sections 323 to 357 deal with remission and Rule 632 provides for early release of sick prisoners, who have been so certified by the Medical Board in terms of that Rule.

¶2The respondents, who are represented by Mr.A.Amarnath, learned counsel for the Government of Tamil Nadu accedes to the receipt of the representation and states that the same is under consideration of the authorities.

¶3Recording the same, there is a direction to R1 to consider representation/petition of the petitioner dated 03.07.2026 and pass orders in accordance with the extant Rules, within a period of six (6) weeks from today and communicate the same immediately to the convict and his family members.
