V.Vinayagam v. The Secretary to the Government

Order (Order of the Court was made by C.Kumarappan J.) The present Writ Petition has been filed praying for a Mandamus to directing the respondents 2 to 7 to remove the encroachments lying within Survey Nos.508 and 530.

¶2Learned counsel for the petitioner would submit that the Survey Nos. 508 and 530 are Government promboke and that there are encroachments. Therefore, the authorities have to initiate action in accordance with law to remove the encroachments.

¶3Learned Additional Government Pleader, on written instructions from the Page3 of 6 Tahsildar, would submit that S.F.Nos.,508 and 530 are Government promboke, classified as pathway and temple and that there are encroachments of 18 cents and they would remove the encroachments by following due procedure of law.

¶4In view of the above submission, this Court deem it appropriate to direct the 2nd respondent to initiate action in accordance with law and remove the encroachments within a period of twelve weeks from the date of receipt of a coy of this order.
