Pursuant to the order of this Court dated 10.10.2023, notice was issued to the appellant to engage another counsel. As per the office report dated 6.11.2023, notice to engage another counsel was issued to the sole appellant by registered post fixing 16.11.2023 was returned with the report that the Manager Dhanya Kumar Jain is dead and, therefore, the notice was returned. I have seen the registered post cover and thereon, the name of the appellant as appearing in the second appeal has been mentioned. Since, the undelivered cover has been received back, therefore, it appears that the appellant is not interested to press the appeal. This appeal is, accordingly, dismissed for non-prosecution.
