¶1Case called out. None appears on behalf learned counsel for applicants to press the present application. However, learned counsel for Opposite Party No.2 and Sri Prem Prakash Tiwari, learned AGA for State are present.

¶2On 24.11.2023, this court has passed the following order :- " 1. None is present on behalf of the applicants as well as the opposite party no. 2.

¶2The instant application was filed seeking quashing of the order dated 13.02.2006 passed by the Additional Chief Judicial Magistrate, (third), District Meerut in Complaint Case No. 852 of 2005 (Pradeep Gupta versus Manohar Lal Jain and ors) under Sections 406, 120B, 504, 506 I.P.C. Police Station-Sadar Bazaar, Meerut.

¶3Vide order dated 25.05.2006, this matter was directed to be listed along with Criminal Misc. Application No. 3904 of 2006 and till then the further proceedings of the Complaint Case were stayed.

¶4However, thereafter the matter was listed three times and the interim order was lastly extended on 20.09.2006, thereafter the matter could not be taken up.

¶5From the status of the case with which this matter was connected it appears that the said Criminal Misc. Application has already been dismissed in default on 13.12.2021.

¶6Put up this matter on 08.12.2023.

¶7Interim order, granted earlier, stands vacated. "

¶3Despite the aforesaid order, none is appearing on behalf the applicants to press the instant application, therefore, the instant application is dismissed for want of prosecution. Date :- 8.12.2023 Akram High Court of Judicature at Allahabad
