¶1Heard Sri Brijesh Kumar Mishra, learned counsel for the applicant and Sri Kamlesh Kumar Triapthi, learned AGA for the State.

¶2The instant application under Section 482 Cr.P.C. has been filed seeking quashing of the charge sheet dated 10.10.2020 as well as the entire proceeding of Case No. 2368 of 2020 (State vs. Ram Milan Rathaur) arising out of Case Crime No. 701 of 2019, under Sections 354, 323, 504, 506 IPC and 7/8 Protection of Children from Sexual Offences Act, 2012, P.S. New Agra, District Agra, pending in the court of Special Judge, POCSO Act / Additional District Judge, Court No. 27, Agra.

¶3Learned counsel for the applicant seeks to withdraw the instant application as the same is the second 482 application filed by the applicant for the same cause of action, for which another Appliction under Section 482 No. 21690 of 2021 is already pending.
