Judgment
Court No. - 46 Case :- CONTEMPT APPLICATION (CRIMINAL) No. - 10 of 2023 Applicant :- In Re Opposite Party :- Shri Abhilash Chandra Trivedi (Advocate) Counsel for Applicant :- Suo Moto,Sudhir Mehrotra Counsel for Opposite Party :- Saurabh Chaturvedi Hon'ble Ashwani Kumar Mishra,J. Hon'ble Syed Aftab Husain Rizvi,J. The contempt proceedings have been initiated by the opposite party on a reference made by the court concerned regarding an incident occasioned during the proceedings of sessions trial no.262 of 2005 on 23.03.2023. Considering the fact that accused contemnor was proceeded under contempt proceedings earlier also and this was a second contempt proceeding, this Court had restrained the contemnor from entering the court premises vide order dated 16.10.2023. The contemnor has submitted his unconditional apology before this Court by filing his affidavit. The unconditional apology has also been tendered by the contemnor before the court concerned. Sri Sudhir Mehrotra appearing for the Court states that Officer concerned has accepted the unconditional apology tendered by the contemnor. Sri I.K. Chaturvedi, learned Senior Counsel for the contemnor assures the Court that the contemnor shall not repeat any such act henceforth. Sri I.K. Chaturvedi also points out that contemnor is a 65 year old advocate and apart from two instances, he has never had any other complaint regarding his conduct as a counsel. Considering the facts and circumstances of the present case, as also the fact that the Officer concerned has accepted the unconditional apology submitted by the contemnor, we deem it appropriate to consign the contempt proceeding with the observations that conduct of the contemnor shall remain under watch for the next two years. The restraint imposed upon the contemnor from entering the court premises is accordingly withdrawn, and the contempt petition is consigned to records. Order Date :- 6.12.2023 C.
