¶1Case called out. None is present on behalf of the applicant to press the instant application. However, Sri Pankaj Srivastava, learned AGA for State is present.

¶2On 14.09.2023, this court has passed the following order :- "1. None appears for the applicant. Shri Pankaj Srivastava, learned AGA for the State is present.

¶2In this case, statement made by the learned counsel for the parties that the matter has been settled between the opposite party no.2 and the applicant, a notice was issued on 8.07.2008 and further proceedings of the case were stayed.

¶3As per office report dated 28.9.2022, the notice was personally served upon opposite party no.2, however there is no appearance on behalf of opposite party no.2.

¶4This matter was listed on 1.08.2023 and 30.8.2023, however none appeared on behalf of applicant to press the instant application as the lawyers were abstained from work on both dates.

¶5Today also none is present on behalf of applicants, therefore, put up this case on 28.09.2023 peremptorily. "
