Order on the Writ Petition In compliance with the order dated 31.10.2023, a supplementary short counter affidavit has been filed in Court today. It is taken on record. Let it be numbered by the office. In Paragraph No.2 of the affidavit filed today, it is averred: "2. That in compliance of order dt. 31.10.2023 passed by this Hon'ble Court the arrears of GIS of the petitioner's husband has been credited to petitioner's account no. 424302010008877 of Union Bank of India, amounting to Rs. 17,970.00 by way of RTGS on 9.11.2023. In this regard deponent may refer to payment sheet issued by the Accounts Officer dt. 9.11.2023, wherein the name of the petitioner's husband is mentioned at serial no. 4, a copy of the same is annexed herewith and is marked as Annexure-1 to this affidavit. It may be mentioned that the remaining dues of the petitioner's husband has already been paid and thus all the claimed as prayed by the petitioner in the aforementioned writ petition has been addressed and accordingly the present writ petition has become infructuous and this Hon'ble Court may pleased to pass necessary orders as this Hon'ble Court may deem fit and proper under the circumstances of the case." When the case is called on, no one appears on behalf of the petitioner. Considering what is recorded in the order dated 06.09.2023 and further payment evidenced by the supplementary short counter affidavit filed today, it appears that the cause of action involved in this petition no longer survives. It is consigned to record. In case, the petitioner has any surviving grievance, it will be open to her to make an application in the decided matter. Order on the Stay Application Disposed of.
