Judgment

Court No. - 36 Case :- WRIT - A No. - 14887 of 2020 Petitioner :- Sangram Singh Yadav Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Yadvesh Yadav,I.P. Singh Counsel for Respondent :- C.S.C. Hon'ble Manjive Shukla,J.

¶1Heard Mr. Saurabh Kumar Jaiswal advocate holding brief of Mr. I.P. Singh, learned counsel appearing for the petitioner and learned Standing Counsel appearing for the Respondents No. 1, 2 & 3.

¶2Petitioner through this writ petition has prayed for a direction from this court thereby commanding the respondents to pay full pension to the petitioner w.e.f. the date of his retirement i.e.

31.03.2018.

¶3Learned counsel appearing for the petitioner has submitted that petitioner was appointed on the post of Assistant Teacher in Maa Kalika Adarsh Vidyalaya Aurangabad, District Ghazipur on 18.10.2001. It has further been submitted that the aforesaid institution is under grant in aid of the Government of U.P. and petitioner has received salary till the date of his retirement i.e.

31.03.2018.

¶4Learned counsel appearing for the petitioner has argued that though after attaining the age of superannuation petitioner retired from service on 31.03.2018 but till date order in respect of payment of full pension has not been issued in favour of the petitioner.

¶5Learned Standing Counsel appearing for the Respondents No. 1, 2 & 3 has opposed the writ petition and has submitted that petitioner is not entitled for the payment of pension.

¶6I have considered the rival submissions advanced by the learned counsels appearing for the parties and it appears that grievance of the petitioner can very well be considered and decided by the Respondent No. 3.

¶7In view of the aforesaid reasons, this writ petition is finally disposed of with liberty to petitioner to file a fresh representation before the Respondent No. 3 within a period of three weeks from today and if such representation is filed, Respondent No. 3 is directed to consider and decide the said representation by passing speaking and reasoned order within a period of two months thereafter.
