(Order on the Writ Petition) An affidavit dated 25.10.2023 has been filed by Mr. Satyam Singh, learned Counsel for respondent No. 2, where a stand has been taken in paragraph Nos. 4, 5, 6 and 7 as follows :

¶4That it is relevant to state here that the petitioner has been paid entire amount of earned leave encashment of Rs. 41993/- has been paid through cheque no 001351 dated 04-02-2020 The photocopy of payment receipt dated 04-02-2020 is being filed herewith and marked as Annexure no.2 to this affidavit

¶5That so far as payment of entire amount of GIS of Rs. 65846/- has been paid to him through cheque no. 5079 dated 19-12-2022. The photocopy of payment recept dated 19-12-2022 is being filed herewith and marked as Annexure no.3 to this affidavit. That so far as payment of entire amount of gratuity of Rs. 328970/- has been paid to him through RTGS on 15-03-2023 after receiving loan from stategovernment. The photocopy of statement of account is being filed herewith and marked as Annexure no.4 to this affidavit.

¶7That out of petitioner provident fund of Rs. 1776161/- the petitioner has been paid Rs. 50,000/- through cheque no. 116511 dated 31-07-2022. The photocopy of payment receipt is being filed herewith and marked as Annexure no.5 to this affidavit. Rs.950000/- has been paid to the petitioner through cheque no. 510397 dated 29-08-2023 through RTGS dated 15-09-2023. The photocopy of payment receipt is being filed herewith and marked as Annexure no.6 to this affidavit and the remaining amount Rs.7,76,161/- has been paid to the petitioner through cheque No.510404 dated 06.10.2023. The photo copy of the payment receipt along with cheque dated 06.10.2023 is being filed herewith and marked as Annexure No.7 to this Affidavit. Learned Counsel for the petitioner states that the petitioner has received all his post-retiral benefits. No further cause of action survives in this writ petition.
