Order on writ petition Heard Mr. Kunwar Mayank Singh, learned Counsel for the petitioner, Mr. Sudarshan Singh learned Counsel for Union of India and Mr. Gopal Misra, learned Counsel on behalf of respondent nos. 1 to 4. A supplementary affidavit has been filed on behalf of the petitioner in Court today. It is taken on record. Let it be numbered by the Office. In paragraph no.6 of the said affidavit, it is averred: "6. That in pursuance of the above referred Order dated 09.10.2023 passed by this Hon'ble Court in this Writ Petition the Respondent Company (ITI Ltd.)/ Respondent No.4 has paid a sum of (a) Rs. 5,44,296/- towards Privilege Leave Encashment in the Bank Account of the Petitioner through R.T.G.S. on 13.10.2023 although the said amount became payable to the Petitioner at the time of the Retirement of the Petitioner (On 30.11.2017)." Though the petitioner raises a claim on account of interest, this Court is not minded to grant interest because leave encashment is afterall not a statutory due like pension or gratuity where interest has to be awarded. In the totality of circumstances, this Court is of opinion that no further orders are required to be made on this petition. This petition is consigned to record. Order on Civil Misc.
