¶1Heard Sri Prakhar Saran Srivastava, learned counsel for the applicant and learned A.G.A. for the State.

¶2The present application has been filed for directing the Judicial Magistrate-II, Ballia to decide the application dated 18.9.2021 and abate the proceedings of Case Crime No. 660 of 2015, under Sections 147, 323, 506 I.P.C., P.S. Bansdeeh Road, District Ballia.

¶3Contention of counsel for the applicant is that the record of court of the Judicial Magistrate-II, Ballia of Case Crime No. 660 of 2015, under Sections 147, 323, 506 I.P.C., P.S. Bansdeeh Road, District Ballia got destroyed in fire and his application dated

18.9.2021 is pending for reconstruction of record or abatement of proceedings in absence thereof.

¶4Considering the aforesaid circumstances, the Judicial Magistrate-II, Ballia is directed to decide the application dated

18.9.2021, filed by the applicant in Case Crime No. 660 of 2015 within a period of one month form the date of production of a copy of this order.
