¶1None appears for the applicants to press the instant application. Sri Yogendra Singh, learned AGA is present on behalf of the State.

¶2Vide order dated 18.11.2012, notice was issued to opposite party no.2 and the proceedings of Case Crime No. 461 of 2009, under Section 306, were stayed by this Court. On 06.07.2017, this Court passed the following order when none was present on behalf of the applicant to press the instant application: "List is revised. Learned counsel for the applicant is directed to take fresh steps within seven days through ordinary course as well as registered A. D. post for effecting service upon O. P. no.2. Office is directed to issue notice to serve O. P. no.2 through the C. J. M. concerned returnable within a period of four weeks from today to enable O. P. no.2 to file counter affidavit. List after expiry of aforesaid period. Interim order, if any as it existed on date, is extended till the next date of listing"

¶3However, as per the office report dated 22.08.2017, no steps have been taken on behalf of the applicant in terms of the said order dated 06.07.2017 and no one is present on behalf of the applicant today to press the instant application.
