for
the State/opposite party no.1 and perused the record. 2-By means of this application, the applicant has prayed for expeditious disposal of case being Case No. 1910 of 2012 ( State Vs. Jawahir and others) arising out of case Crime No.292 of 2011, under Sections 323, 504, 506 IPC, Police Station-Pipraich, District-Gorakhpur, pending in the Court of Additional Chief Judicial Magistrate, Room No.20, Gorakhpur, within the time-bound frame. 3-It is submitted by learned counsel for the applicant that the applicant is informant / complainant in this case. It is an old matter of the year 2011. F.I.R. was lodged on 16.11.2011, in which, charge sheet was submitted against the accused persons on
27.12.2011. Thereafter, they have appeared before the trial Court and obtained bail on 30.04.2013, but till date, on account of moving repeated adjournment applications by the accused persons and allowing the same by the trial court, no effective proceeding of trial is going on. 4-Learned A.G.A. states that no useful purpose would be served in issuing notice to opposite party nos. 2 to 5 and keeping this application pending before this Court and it may be disposed of at this stage itself. 5-Certified copy of the complete order sheet of the trial Court has been brought on record along with this application and perusal of the same, this Court fails to understand as to why repeated adjournment applications of the accused persons are being allowed by the concerned Magistrate. 6-Considering the limited grievance of the learned counsel for the applicant, learned trial court is directed to make an endeavour to decide the aforesaid case, as expeditiously as possible, preferably within a period of six months from the date a certified copy of this order is produced before it, if there is no legal impediment. 7-It is made clear that the trial court shall not grant any adjournment to the parties concerned. 8-With the aforesaid directions, this application is disposed of.
