¶1Instructions filed by learned Standing Counsel is taken on record.

¶2Heard learned Counsel for the parties and perused the record.

¶3The present petition has been filed for the following relief :

(i) Issue a writ, order or direction in the nature of mandamus directing to the respondent no.2 shall take decision on the application of the petitioner dated

10.08.2023 regarding removal of the illegal Nali has been constructed in the bhumidhari land of the petitioner by collusion of concerned Lekhpal and revenue Inspector."

¶4By the order dated 6.10.2023, learned Standing Counsel was directed to seek instructions. Today, on the basis of instructions, learned Standing Counsel states that a Nali has not been constructed over the bhumidhari land of the petitioner, therefore no further order is required to be passed in the matter.

¶5In case, the petitioner is aggrieved, he may get his bhumidhari land demarcated in an appropriate proceedings under Section 24 of the U.P. Revenue Code, 2006.
