¶1The present writ petition has been preferred by the petitioner against the respondent no.3, who is her father claiming certain rights.
¶2Learned Standing Counsel has raised an objection regarding maintainability of writ petition on the ground that the disputed question of facts are involved in this matter between the private parties, which cannot be adjudicated in writ jurisdiction under Article 226 of the Constitution of India.
¶3After substantial arguments once the Court has declined to entertain the writ petition, learned counsel for the petitioner fairly states that he is not inclined to press this writ petition and the same may be dismissed as not pressed, however, leave may be accorded to the petitioner to press the relief before appropriate Court/authority.
¶4Accordingly, the writ petition is dismissed as not pressed with the aforesaid leave. Order Date :- 31.10.2023 S.P. High Court of Judicature at Allahabad
