¶1Heard Sri Akash Tomar, learned counsel for the petitioner as well as Sri G.P. Singh, learned AGA appearing for the State respondents.

¶2Present petition has been filed with a prayer to direct the respondents concerned to ensure free, fair and impartial investigation in case Crime No. 199 of 2022, under Sections 147, 148, 149, 506, 120B and 302 IPC, Police Jani, District Meerut.

¶3Admittedly, the petitioner approached the learned Magistrate on which apparently a letter had already been written on 23.9.2022 and instructions of learned AGA is to the effect that FSL report is still awaited.

¶4In view of judgement of this Court in Ajay Kumar Pandey versus State of U.P. and 2 others reported in 2021 (2) ADJ 239, present petition stands disposed of with liberty to the petitioner to file appropriate application before the Magistrate along with certified copy of this order for the purpose of appropriate direction/orders from the Court in exercise of power under Section 156 (3) CrPC.
