(Order on the Writ Petition) A supplementary compliance affidavit has been filed by Devendra Singh, Sub-Divisional Magistrate, Pilibhit (presently holding the charge of the Executive Officer, Nagar Palika Parishad, Pilibhit). The affidavit is taken on record. The Executive Officer, Nagar Palika Parishad, Pilibhit is present in Court, in compliance with the order dated 06.11.2023. In paragraph Nos. 6, 7 and 8 of the affidavit, it is averred :

¶6That, as per audit objection 31,000/- Rs. dues was made out on the petitioner and notice was issued to the petitioner regarding that amount. The copy of audit objection with notice issued by Nagar Palika Parishad, Pilibhit to the petitioner is being filed herewith and marked as Annexure No. S.A.2 to this affidavit.

¶7That, as per audit objection 31,000/- Rs. deducted from total amount of petitioner and sum of Rs. 1001624/- paid to the petitioner through PFMS in account of petitioner on 1.11.2023. The copy of payment detail of the petitioner with bank statement of Nagar Palika is being filed herewith and marked as Annexure No. S.A.3 to this affidavit.

¶8That, at the present time the pension book of the petitioner send to the Commissioner, Bareilly Division, Bareilly through District Magistrate, Pilibhit on 21.10.2023. The same may be released after sanction of competent authority. In view of the fact that all due payments of the petitioner have been made, no further orders are required to be passed on the petition. It is, accordingly, consigned to records. The personal presence of the Executive Officer, Nagar Palika Parishad, Pilibhit is exempted. (Order on Civil Misc. Stay Application No. 1 of 2023) Disposed of.
