C.S.C. submitted that in this matter he has received instructions in which it discloses that the petitioner no.2 is already married and he has seven children from the first marriage. Moreover, he is not residing at the given address in the petition while he is residing at Haryana. In view of above, the writ petition is dismissed with cost of Rs. 20,000/- upon petitioner no.2 for misusing the process of law. Interim order, if any, stands vacated. The Chief Judicial Magistrate, Muzaffarnagar is directed to realise the amount of cost and deposit the same to District Legal Services Authority, Muzaffarnagar.
