¶1The petitioner has preferred the present petition with the following prayer:- "(i) Issue a writ, order or direction in the nature of Certiorari §quashing/set-aside the impugned judgment and orders dated 04.11.2022 and 18.11.2022 [Annexure No. 3 & 4 to this writ petition] passed by the respondent No. 1, in case No. 630/2019 [Computer Case No. D201903410000630) {Moris Dhara & others Vs. Manju Soleman] from the House No. 15/42A, Civil Lines Kanpur Nagar.

(ii) Issue a writ, order or direction in the nature of Mandamus commanding & directing the respondent No. 1 to decide the application under Section 16[5] of U.P. Act No. 13 of 1972 registered as Case No. 01/2023 "Renu Harvey @ Anugrahi Abigel Man Singh Vs. Moris Dhar and others" pending before the respondent No.1.

(iii) Issue a writ, order or direction in the nature of Mandamus commanding & directing the respondent No. 2 not to dispossess the petitioner in pursuance of vacancy order dated 04.11.2022 [Annexure No. 3 to writ petition] and judgment and order dated 18.11.2022 [Annexure No.4 to this writ petition] passed in Case No. 630/2019 "Moris Dhar and others Vs. Manju Soleman and others" from the ground floor of disputed House No. 15/42A, Civil Lines, Kanpur Nagar."

¶2After some arguments, a prayer has been made by learned counsel for the petitioner to dismiss the present petition as withdrawn with liberty to file fresh petition.

¶3Learned Standing Counsel has no objection to the aforesaid prayer.

¶4Accordingly, the present petition is dismissed as withdrawn with liberty as prayed.
