This writ petition has been filed by the petitioner with a prayer to quash the impugned order dated 26.12.2022 passed by respondent no.4/Sub Divisional Magistrate, Tilhar, District-Shahjahanpur and a further prayer to direct the respondent no.3 to constitute a District Level Committee and conduct a fresh inquiry with regard to complaint so filed by petitioner on

23.06.2022 and provide full opportunity of hearing to the petitioner as well as the card holders. This is a complainant's petition. The petitioner is a complainant, who has made complaint against the licensee of Fair Price Shop holder, alleging illegality and irregularity in the distribution of essential commodities. Learned Standing Counsel on the other hand submits that the petitioner has no locus to file such petition, therefore, this petition is not maintainable. In support of his contention, he has relied upon the judgement of this Court in the case of Lakki Sonkar vs. State of U.P. and 5 others passed in Writ -C No. 11528 of 2023.
