1.Learned counsel for the petitioner is permitted to implead Tehsildar-Dhanaura, District-Amroha as respondent No.12 in the array of the parties to the P.I.L.

¶2In compliance of the order dated 23.11.2023, instruction dated

06.12.2023 sent by Sub Divisional officer is placed before the Court, which is taken on record.

¶3Heard learned counsel for the petitioner, Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State-respondents and Mr. Arun Kumar Pandey, learned counsel for respondent No.4/Land Management Committee.

¶4Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State-respondents on the basis of the instruction submitted that in respect to the plot Nos.80, 71, 120, 119, 62, 123 and 130 proceeding under Section 67 have been registered against the persons who are in possession over the same. He further submitted that in respect to plot No. 120, 120kha, 129 ka, 444, 449, 737, 759, 52 there is no encroachment. He further submitted that encroachment has been removed from plot No. 25, 53, 54, 56, 27, 58, 99, 303, 389, 476, 579, 614, 616, 998, 718, 439 and 514.

¶5In view of the instruction sent by the Sub Divisional Magistrate, Dhanaura, District Amroha, the P.I.L. is finally disposed of directing respondent No.12/Tehsildar, Dhanaura, Amroah to decide the cases under Section 67 of U. P. Revenue Code, 2006, which has been mentioned in the instruction dated

06.12.2023 sent by Sub Divisional officer in accordance with provisions contained under U.P . Revenue Code, 2006 and Rules framed thereunder after affording proper opportunity of hearing to the parties. Order Date :- 8.12.2023 PS* High Court of Judicature at Allahabad
