¶1This writ petition has been filed for challenging the Sale Notices dated 24.08.2023 and 14.09.2023. Learned counsel for the Bank Sri Pankaj Srivastava states that in pursuance of the auction notice auction had been held and also sale certificate had been issued.

¶2Learned counsel for the Bank, therefore, states that as per the judgment of the Supreme Court in Celir LLP vs. Bafna Motor (Mumbai) Pvt. Ltd. & Ors. (Civil Appeal Nos.5542-5543 of 2023 decided on 21.9.2023) no interference be made by this Court.

¶3We find substance in the submissions of learned counsel for the respondent-Bank.

¶4In view of the judgment of the Supreme Court in Celir LLP (supra), no interference can be made.

¶5The writ petition is, accordingly, dismissed. The petitioner may avail such remedy as might be available to him under The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. Order Date :- 16.11.2023 vkj High Court of Judicature at Allahabad
