¶1Heard learned counsel for the petitioner as well as learned Standing Counsel.

¶2Petitioner who is seeking promotion from the post of Sub Inspector to Inspector, has come up before this Court with the prayer that the sealed envelope may be permitted to be opened in the light of provisions contained under the Government Order dated 28.05.1997 read with 09.01.2018.

¶3It is argued by learned counsel for the petitioner that the sealed cover procedure was adopted in the matter of petitioner on

28.02.2018 on account of pending criminal case in connection with case crime no. 364 of 2012/367 of 2012 under Sections 147/342/302 of Indian Penal Code wherein after investigation final report got submitted on 28.08.2012. Thereafter, petitioner filed a protest petition before the Court below which came to be allowed by learned Magistrate. However, it is submitted that the trial is going on and petitioner in no circumstances responsible for the delayed criminal proceedings and therefore, his claim to open the seal cover for promotion on the post of Inspector is liable to be considered in the light of provisions as contained in para 10 of the Government Order (supra). Para 10 of the Government Order is reproduced hereunder: "(10)

¶4Learned Standing Counsel submits that the matter can be directed to be examined in the light of provisions as contained in para 10 of the Government Order by the competent authority in the matter which has been represented with.

¶5In view of the above, this petition stands disposed of with a direction to the competent authority to look into and consider the representation of the petitioner in the light of provisions as contained in para 10 of the Government Order and pass appropriate, reasoned and speaking order within a period of two months of presentation of certified copy of this order. It is further provided that in the event respondents comes to conclude that the petitioner is entitled to benefit of reopening of the sealed envelop, the same shall be reopen and petitioner be offered ad hoc appointment subject to the conclusion of trial and be paid salary accordingly.
