Sinha, learned Standing Counsel appearing on behalf of the State. An affidavit of respondent No. 2 has been filed by Santosh Kumar Sharma, Nagar Ayukt, Nagar Nigam, Shahjahanpur. In paragraph Nos. 12 and 13 of the affidavit, it is averred :

¶12That the amount of pension arrear of pension and amount of gratuity-1129352.00, leave incashment-16806.00, and amount of arrear of ACP-56004.00, ( total amount-1202162.00, twelve Lakhs two thousand one hundred sixty two) is transfer in the account of Nilam Mishra account No. XXXXXXX9245, IFSC Code MAHB0001761 on 27.11.2023 through RTGS. A true/photo copy of receipt of payment of amount Rs. 1202162.00 (Twelve Lakhs two thousand one hundred sixty two) dated

27.11.2023 is being filed herewith and marked as Annexure No.6 to this affidavit.

¶13That the provident fund, group insurance, pension, arrear of pension, leave incashment and arrear of ACP are paid to the petitioner. Learned Counsel for the petitioner states that the petitioner has received all dues of post-retiral benefits in his account, and now, no further cause of action survives.
